Terms of Use

1. Agreement to Terms

By downloading, installing, or using BigZ (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and Metalab, a company incorporated in Estonia ("BigZ," "we," "us," or "our").

2. Eligibility

You must be at least 16 years old to use BigZ. By using the App, you represent that you meet this age requirement. You are responsible for ensuring that your use of BigZ complies with all applicable laws in your jurisdiction.

3. Account Registration

To access BigZ features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Keeping your account information accurate and up to date

You may not create accounts on behalf of others without authorization, impersonate any person, or use a false identity. We reserve the right to suspend or terminate accounts that violate these Terms.

4. License

Subject to your compliance with these Terms and payment of applicable subscription fees, BigZ grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial strength training purposes.

You may not:

• Copy, modify, distribute, or create derivative works of the App
• Reverse engineer or attempt to extract source code
• Use the App for any commercial purpose without our written consent
• Circumvent any access controls or subscription restrictions
• Use automated means to access, scrape, or interact with the App

5. Subscription and Payments

BigZ offers a 14-day free trial for new users, after which continued access to premium features requires a paid subscription. All payments are processed by Apple or Google. We do not handle your payment information directly. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.

6. Training Content and AI Coaching

BigZ provides AI-assisted coaching, training programs, and performance recommendations. You acknowledge that:

• Training recommendations are generated by an automated rule-based engine informed by the data you provide
• The quality of recommendations depends on the accuracy of the data you enter
• You are solely responsible for deciding whether to follow any training suggestion
• You must stop training and seek medical attention if you experience pain, injury, or medical symptoms

7. User-Generated Content

BigZ may allow you to submit content including performance logs, profile information, and community contributions ("User Content"). By submitting User Content, you:

• Grant BigZ a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the App
• Represent that you own or have the right to submit the content
• Agree not to submit content that is abusive, defamatory, illegal, or that violates another person's rights

We reserve the right to remove User Content that violates these Terms without notice.

8. Prohibited Conduct

You agree not to:

• Violate any applicable law or regulation
• Use the App to harm, harass, or threaten any person
• Upload false, misleading, or fraudulent data
• Interfere with the App's servers, networks, or infrastructure
• Attempt to gain unauthorized access to other users' accounts or data
• Use the App in any way that could damage, disable, or impair its functionality

9. Intellectual Property

All content, design, trademarks, and technology in BigZ — including but not limited to the BigZ name, logo, coaching engine, training programs, and AI systems — are owned by or licensed to Metalab and are protected by applicable intellectual property laws.

The name, likeness, and expertise associated with Zydrunas Savickas are used under license and agreement with Zydrunas Savickas. Unauthorized use of his name or likeness is prohibited.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT TRAINING RECOMMENDATIONS WILL PRODUCE ANY PARTICULAR RESULT. YOU USE THE APP AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, METALAB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, revenue, or profits
• Physical injury or health consequences arising from following training recommendations
• Any damages exceeding the amount you paid to BigZ in the 12 months preceding the claim

SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS — IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to defend and indemnify Metalab against any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time through the App settings. Upon termination, your license to use the App ends immediately. Data deletion follows the process described in the Privacy Policy.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia and applicable European Union regulations, without regard to conflict of law principles. Any disputes arising from these Terms shall be submitted to the jurisdiction of the courts of Estonia. For consumers within the EU, mandatory consumer protection rights under your country of residence are not affected.

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or in-app notification at least 30 days before the effective date. Continued use after the effective date of changes constitutes acceptance.
